It is the second last meeting of this council before local government elections are held on December 4.
Land classification - Clarke Street, Broulee
Council Planning and Sustainability director Lindsay Usher will present a report to council outlining a number of options to resolve the issue of the land classification.
Councillors will consider four options and vote on the option to proceed with:
- Leave the lot as is, being operational land and keep the road reserve as road reserve.
- Close the road reserve, apply to the NSW Government to have the (former) road reservetransferred to council and classify the road reserve and the lot as community land.
- Leave the road reserve as is and reclassify the lot as community land.
- Close the road reserve, apply to the NSW Government to have the land (former) road reserve transferred to council. Develop the lot and the road reserve into residential lots and then sell.
A decision by the Eurobodalla Shire Council in 2003 to reclassify the operational land as community land was not enacted, despite the motion being strongly supported by the community.
In August, Mr Usher said his team was working to rectify the issue, but it was complex and would take some time.

Bay Pavilions fees and charges
Council will vote to adopt a new schedule of fees and charges for the new Bay Pavilions following community consultation.
The fees and charges were place on public exhibition for 28 days and council received 11 which raised three general themes:
- Fees and charges are too high and not affordable.
- Fees and charges for gym entry and memberships are too low.
- Some general queries were asked on how to interpret and apply the fees and charges.
Council reviewed the submissions and the following amendments are proposed:
- Remove the $2.50 spectator fee
- Add a concessional rate of $12 for older adults/pilates/yoga/wellness class
- Reduce the concessional rate from $13 to $12 for group exercise class (casual visit)
- Allow for promotions by accepting periods of no joining fee and free membership trial
- Increase the standard adult rate ($15) for Older Adults/Pilates/Yoga/Wellness Class to align with the pricing for Group Exercise Adult Class
- Change working of "health and fitness" to "group exercise"
In relation to suggestions council would undercut Batemans Bay gyms with the original proposed fees and charges, council papers said the gold and platinum membership prices were amended to ensure a fair comparison to gym pricing in the region.
Public gate at Coopers Island Road
Coopers Island Road is a public road which intersects a private property where the landowners run a wagyu beef cattle business.
It is the owner's responsibility to reduce the risk of their stock from staying from the property onto public land, including public roads. As a result, the owners have submitted a permit for a gate to assist with this objective.
Council will consider the application with two options presented to resolve the matter.
During the public exhibition period of the application, council received 10 submissions from nine members of the public. Seven of the submissions were against approving the gate application and two did not explicitly state their support or oppose the application.
The main objection to the formal approval for a public gate on Coopers Island Road was the potential barrier to access Trunketabella Lake, a recreational fishing haven.

Fence at Coopers Island Road
Council will vote on a matter regarding unapproved fencing on the road reserve near the intersection of Coopers Island Road and the Princes Highway in Bodalla.
In order to resolve the illegal use of the public road reserve, council will ask the adjoining landowner to remove the unapproved fencing and install fencing on the boundary of the Road Reserve and the landowners property.
