The ACT's top judge is set to decide within days whether or not to scrap or delay the trial of the man accused of raping former Liberal Party staffer Brittany Higgins.

In the ACT Supreme Court on Friday, Chief Justice Lucy McCallum heard Bruce Lehrmann's application for his case to be stayed either permanently or temporarily.
Mr Lehrmann is currently scheduled to stand trial in June, having pleaded not guilty to a charge of sexual intercourse without consent.
The Queensland man denies allegations he raped Ms Higgins at Parliament House in March 2019, when the pair worked there.
Almost none of what occurred on Friday can be reported because Chief Justice McCallum put in place a non-publication order over all the evidence put before the court.
She also banned publication of the submissions made by the barristers who appeared for parties to the proceedings.
Chief Justice McCallum ultimately reserved her decision on the application for a stay, indicating she was likely to publish a judgment some time next week.
